Reorganisation of the law relating to food and feedstuffs

The German Foodstuffs and Commodities Act , in force since 1974, was replaced by the Food- and Feedstuffs Code (LFGB) on September 7, 2005. The former provisions relating to health and consumer protection have largely been adopted. The situation has changed, however, as far as the term food has been redefined.

The previous definition according to which food is intended for nutrition and/or enjoyment is no longer a necessary characteristic of food. Drastic changes thus follow regarding the highly controversial question of how to differentiate between food and drugs; this is particularly true in view of a new definition of drugs which was introduced at about the same time. In practice, problems of demarcation mainly arise for certain products such as food supplements, for instance.
